I. General information
- Elhurt EMS Sp. z o. o. with its registered office in Gdańsk, Galaktyczna 35 a, 80-299 Gdańsk, entered into the register of entrepreneurs kept by the District Court Gdańsk – Północ in Gdańsk, 7th Commercial Division of the National Court Register under the KRS number: 0000293807, establishes the Privacy Policy along with the rules of use of the website www.elhurtems.com
- Whenever this Privacy Policy refers to the website www.elhurtems.com, it means all the websites to which the website www.elhurtems.com refers and which are administered by Elhurt EMS Sp. z o. o. [hereinafter: Website].
- The controller of the Website user’s personal data (data provided in contact forms or orders, cookie files and other data processed on the Website) is Elhurt EMS Sp. z o. o. with its registered office in Gdańsk, hereinafter referred to as: „Controller”.

- The legal basis for the processing of your data by the Controller is:
a). A contract between you and the Controller, concluded as a result of acceptance of the Regulations and for the performance of which the processing of your data is necessary (in the case of using the Website), or
b). sales contract concluded via the Controller’s online store, for the performance of which the processing of your data is necessary, or
c). Your consent, in the event of contact via one of the contact forms available on the Website or
d). The Controller’s legitimate interest in processing your data for marketing purposes. - The Controller guarantees the confidentiality of all personal data provided to him.
- Your personal data is processed solely for purposes related to the implementation of the contracts mentioned above and to take necessary actions before their conclusion or in connection with the implementation of the Controller’s legitimate interest in the marketing of its products or services.
- Providing personal data is voluntary, however, failure to provide them or failure to consent to certain functionalities (cookies) will make it impossible to conclude and perform contracts or use the Website.
- Your data will be stored for a period that is not longer than necessary, i.e. for a maximum period of 26 months, with the exception of data contained in VAT invoices issued by the Controller or other settlement documents, which will be stored for tax purposes or documents related to possible debt collection for a period of six years from the conclusion of the contract.
- The Controller will transfer your data to recipients dealing with hosting, entities providing courier, accounting, debt collection, insurance, legal, marketing, recruitment, IT and administrative services, as well as payment system providers for the purposes of transactions concluded via the online store.
- The Controller will transfer your data to third countries (USA), but these will only be entities with the EU-U.S. Privacy Shield certificate (Google, Facebook, LinkedIn). You have the right to obtain copies of such data.
- You also have the right to request from the Controller access, rectification, transfer and deletion of your data as well as the right to limit data processing. You also have the right to lodge a complaint with the supervisory authority regarding the processing of your personal data.
- Based on your personal data, the Controller will make automated decisions for you, including decisions resulting from profiling, but only with respect to the selection of the language version of the website and the advertising offer based on your previous transactions and inquiries or other activity on the Controller’s websites. These decisions do not produce any legal effects regarding you or similarly affect your situation.
- You have the right to object at any time – for reasons related to your particular situation – to the processing of your personal data resulting from the legitimate interests of the Controller, including profiling. You have the right not to be subject to a decision that is based solely on automated processing, including profiling, and produces legal effects concerning you or similarly affects you.
II. Cookies
- The Controller, as the owner of the Website, may use cookie files when using these websites. By using them and accepting this Privacy Policy, you consent to the use of cookies.
- Cookie files (called cookies) are small IT data, in particular text files, sent by the website we visit, saved and stored on the end device (computer, laptop, smartphone) you use when browsing websites.
- Cookies, consisting of a series of letters and numbers, contain various information necessary for the proper functioning of websites, e.g. those requiring authorization – including: when logging in to your email account or online store.
- The entity that places cookies on the Website User’s end device and obtains access to them is the Website operator or entities cooperating with it.
- All websites operating on the Internet – search engines, information and news websites, online stores, websites of state offices and other public institutions, can function properly thanks to the use of cookies.
- Cookies further enable, among others, remembering your preferences and personalizing websites in terms of displayed content and advertising matching. Thanks to cookies, it is also possible to register products and services or vote in online surveys.
- Personal data collected using cookies may be collected only to perform specific functions for the user, e.g. remembering login to the website or remembering goods added to the basket in the online store. Such data is encrypted in a way that prevents access to it by unauthorized persons.
- Cookies are used, among others, in order to:
a). Ensure the proper operation of websites (e.g. maintaining sessions, selecting the language version, improving performance, speed of websites, ensuring security),
b). Create and analyse traffic statistics – our company (or our service provider) uses Google Analytics analytical services to find out whether the content we present is useful, what users are interested in and how the operation of the Website can be improved. This information is used for statistical purposes only. We do not use them to identify users,
c). Display advertisements for our products, using social plug-ins, etc. (e.g. playing YouTube videos, tools for sharing articles on Facebook or LinkedIn, Google Maps). - Cookies uploaded on the end device of the Website User may also be used by advertisers and partners cooperating with the Website operator.
- Cookies may be used by advertising networks, in particular the Google network, to display advertisements tailored to the way the user uses the Website. For this purpose, they may retain information about the user’s navigation path or the time spent on a given page. - The Website uses two basic types of cookies:
a). Session cookies – which are temporary files that are stored on the User’s end device until logging out, leaving the website or turning off the software (web browser),
b). Persistent cookies – which are files stored on the User’s end device for the time specified in the cookie parameters or until they are deleted by the User. - You can introduce changes to cookies, including: withdraw your consent to the use of cookies by selecting the appropriate settings in your web browser (in most cases, this option is located in the Tools or the browser’s Preferences menu). The web browser also allows you to delete cookies. Moreover, there are browser add-ons that block e.g. Google Analytics. Remember, however, that disabling cookies may cause difficulties or even prevent the use of the website.

III. Online forms
1. You can transfer your personal data to the Controller using forms that are or may be made available on the Website, in particular:
a). Online store user account registration forms
The data provided as part of the account registration form is processed to enable secure access to the Controller’s electronic services (logging in, reminders, changing the password, making a purchase and electronic correspondence related to the purchase). These data will be processed until the user account is deleted on our website.
b). Newsletter subscription forms
The data provided as part of the subscription form for a given newsletter is processed for the purpose of sending the user the ordered newsletter. The provided data will be processed until you withdraw your consent or submit a request to delete your data.
c). Contact forms
The data provided as part of the contact form is processed in order to respond to the sent correspondence. The data provided in the contact form will be processed until you withdraw your consent or submit a request to delete your data.
d). Recruitment forms
The data provided in such a form is processed only for the needs of a specific recruitment and is deleted within three months of its completion. However, they may be used by the Controller for the purposes of future recruitment for the same or similar position within a period of one year from the end of the calendar year in which the recruitment was completed, if you consent to this when completing the form.
- You can express your voluntary consent to the processing of personal data provided in the forms for marketing purposes by selecting the appropriate consents in the part of the form described as formal consents. Consents will be processed until they are revoked.
- If you send any e-mail correspondence to the Administrator that is not related to the services provided to you or any other contract concluded with you, the personal data contained in this correspondence will be processed solely for the purpose of communication and settling the matter related to the correspondence. These data will be processed for a period justified by the needs of the Controller, but no longer than until you withdraw your consent to their processing or request their removal.
IV. Other website functionalities
Using the Website also involves sending queries to the server where our websites are stored. Each query sent to the server is saved in the server logs. Logs are also collected by the website engine installed on the server and your computer, laptop or other device through which you use the Internet. Logs include, among others: user’s IP address, server date and time, information about the web browser and operating system used by the user. Logs are saved and stored on the server, and the data stored in them are not associated with specific people using the Website and are not used by the Controller to identify the user, but constitute auxiliary material used to administer the Website, and their content is not disclosed to anyone other than entities authorized to administer the server.
V. Children under 16 years of age
We understand the importance of protecting children’s privacy, especially online. The website is intended for children under 16 years of age. One of the policy principles of Elhurt EMS Sp. z o. o. in this respect, it is necessary to refrain from knowingly collecting or storing data about persons under 16 years of age.
